BREEDING CERTIFICATE

Stormy’s Lightning

This contract entered into this _____ day of ________________ between ________________________, hereafter referred to as owner and Rising Star Ranch, hereafter referred to as the Breeding Farm, and ____________________, hereafter referred to as the buyer.

1. The stud fee for Stormy’s Lightning, The Tennessee Walking Horse stallion, shall be $750.00. The $750.00 will entitle mare owner to breed one mare to the stallion for this the 2007 breeding season by artificial insemination, at the Breeding Farm or by shipped semen.

2. A $375.00 booking fee (non-refundable) is to be paid when mare owner signs the breeding certificate. The remaining $375.00 is to be paid when the mare is declared safe in foal or within six months, but shall not succeed the calendar year.

3. If shipping semen, an additional $200.00 shipping fee must be received by Rising Star Ranch ten days prior to each shipment.

4. All stallions will be collected only on Mondays, Wednesdays, Fridays, and Saturdays for farm breeding, pick-ups, and/or haul-ins. Shipped semen collections will be made on Mondays, Wednesdays, and Fridays. Special collections or shipments will result in added charges for the mare owner. There is a $10 lab charge for each mare per pick-up or haul-in. The stallions shall not be collected during the period of July 15^th through September 30 of the breeding season.

5. Any mare to be bred under this contract must be healthy and in sound breeding condition and free from infection and disease. In the event the service is refused or the mare does not get in foal, the buyer has return privileges and may substitute another mare for a period of 12 months from the original breeding date. Stormy's Lightning has a Limited Live Foal Guarantee, “live foal” meaning a foal that stands and nurses. If the mare gets in foal and loses the foal during the regular breeding season, the mare owner shall be permitted to rebreed the mare or substitute another mare for a period of 24 months from the original breeding date.

6. Rising Star Ranch must be notified of mare’s pregnancy status within 90 days of the mare’s last breeding date. If this condition is not met, LLFG is null and void.

7. This certificate may be transferred to another buyer, prior to the designation of the mare to be bred, upon notifying Rising Star Ranch.

8. In the event of the death of the stallion or if he becomes unable to stand as a breeding stallion, as determined by a licensed veterinarian, no refunds will be made.

9. Buyer is bound by the normal rules, regulations, and policies of Rising Star Ranch and must sign a farm breeding contract when mare is delivered for breeding or sign and follow all instructions of the semen shipping contract. Mare owner assumes responsibility of all veterinary expenses, board bills, and any other related expenses incurred in the breeding of the mare. A finance charge of 1.5% per month or 18% annually is applied to past due accounts over 30 days. Mare owner is liable for all legal and collection fees and foal registration papers will not be signed until owner is in good standing with Rising Star Ranch.

10. This agreement constitutes the entire agreement of the parties, and shall be binding on the parties, their heirs, and assigns, and personal representatives.
